The personal database created during ChooseMyCompany is confidential.

ChooseMyCompany also guarantees the confidentiality of personal data collected (names, email addresses and passwords) when registering for its services (discussion forums, HappyIndex®AtWork surveys, HappyIndex®Trainees, salaries, blogs, etc.).

In accordance with the Data Protection Act of January 6, 1978, any user has the right to access, modify, rectify and delete their data.

ChooseMyCompany cannot guarantee either the confidentiality or the deletion of personal data voluntarily posted by the user in the public parts of the site (discussion forums, HappyIndex®AtWork surveys, HappyIndex®Trainees, salaries, blogs)

ChooseMyCompany cannot be held responsible for "spam" suffered by forum users who have decided voluntarily and spontaneously to publish their email address online.

In accordance with the provisions of the law in Confidence in the digital economy of June 21, 2004, data likely to allow the identification of Internet users (and in particular IP addresses) having contributed to the creation of content on the ChooseMyCompany website are held and kept by ChooseMyCompany.

Non-personal statistical data (example: number of unique visitors, average number of pages viewed per user) are analyzed by ChooseMyCompany to understand the usage habits of the ChooseMyCompany website with the aim of improving editorial and community content and informing advertisers, publicists or institutions.

The automatic identification of Users allowing direct access to the ChooseMyCompany discussion forums without having to re-enter the username and password each time they log in requires the installation of a cookie.

Only the ChooseMyCompany moderator is authorized to restore your passwords and login to you, as part of a secure procedure following your request.

You are also informed that if for a period of three years, you do not use the services offered to you by ChooseMyCompany, you accept that your subscription will be deleted, as well as your passwords and login.

ChooseMyCompany cannot be held responsible for the fraudulent use of your password and login by a third party who manages to steal them from you.

All the provisions of this charter apply during your participation in the interactive services offered on the ChooseMyCompany site.

Please therefore respect all legal and regulatory provisions in force, and in particular those described above.

As such, you are solely responsible for the information, messages, images and generally for any content that you distribute via interactive services such as forums/questions and answers.

You accept that ChooseMyCompany takes the initiative, without prior notice, to delete, in whole or in part, any content that you distribute or which is sent to you via the interactive services, if this content is likely to infringe the laws and regulations in force or good morals.

You acknowledge that you are solely responsible for the use that may be made of the content, of whatever nature, that you distribute, and that ChooseMyCompany neither controls nor guarantees the accuracy, legality, quality or reliability of content of any nature whatsoever, distributed via the interactive services offered on the site.

You certify that you are participating in good faith in the participatory sections (salary, position, function, membership of a company, answers to the questions asked, HappyIndex®AtWork and HappyIndex®Trainees questionnaires, etc.).

• a clear desire to harm a company
• desire to bias or falsify the information published on the site
• desire to denounce or denounce practices or people
• of willingness to betray professional secrets.

In the event of abuse in this area, and depending on the nature of the comments, ChooseMyCompany may contact the author of the information for purposes of reformulation or clarification, unilaterally delete the information provided and/or take appropriate legal action.

You are solely responsible for contacts made via the interactive services of the ChooseMyCompany site.

You acknowledge that ChooseMyCompany assumes the sole responsibility of a technical service provider defined in article 6 of the Law for Confidence in the Digital Economy (LCEN) with respect to the content produced by Users as part of the interactive services and as such that:

• ChooseMyCompany assumes no responsibility for the quality and legal compliance of the contents, whatever they may be (texts, sounds, videos, graphics, photos or others) thus produced freely by Users
• ChooseMyCompany may, in accordance with its legal obligations, delete said content after a third party has asserted the illegal nature of the content concerned
• ChooseMyCompany communicates, in accordance with its legal obligations and upon formal request from the judicial authorities, the elements allowing the identification of the Users who have contributed to this content.

You acknowledge that, notwithstanding all the means implemented by the company ChooseMyCompany, the Internet presents technical specificities which make it impossible for ChooseMyCompany to guarantee absolute continuity of access to the service and response times, as well as security in the transmission of data.

In all cases, you acknowledge that the information and services offered on the ChooseMyCompany site:

• may be interrupted for cases of force majeure or beyond the control of ChooseMyCompany or facts not falling within the responsibility of ChooseMyCompany
• may contain errors of a technical or human nature
• may cause occasional loss of data.

In general, ChooseMyCompany does not guarantee the completeness, exhaustiveness and accuracy of the content of the information and services offered on the ChooseMyCompany site, the ChooseMyCompany company using all available means to offer Internet users quality content.

If one or more of the provisions of this charter were invalidated for any reason whatsoever, the other provisions will retain their full force and scope.

In the event of difficulty of interpretation between any of the titles and the clauses to which they relate, the disputed title will be declared non-existent.

These general conditions are governed by French law, for both substantive and formal rules.
